Genta Technology Term of Service

This contract, referred to as the "Agreement," is made between Genta Technology and the individual or entity utilizing the Genta Technology Platform, referred to as "Customer" or "You." It encompasses the terms and conditions outlined below and any Order Forms referencing this Agreement. If you are using the Genta Technology Platform on behalf of your company, you confirm that you have the authority to accept this Agreement on behalf of your company, and all mentions of "you" apply to your company.

BY AGREEING TO THIS AGREEMENT OR ENGAGING WITH THE GENTA TECHNOLOGY PLATFORM, YOU COMMIT TO COMPLY WITH ALL TERMS, CONDITIONS, AND NOTICES INCLUDED OR REFERENCED HEREIN. IF YOU DO NOT AGREE TO THIS AGREEMENT, PLEASE REFRAIN FROM USING THE GENTA TECHNOLOGY PLATFORM. BE ADVISED, UNEQUIVOCALLY, THAT EACH PARTY ENFORCES THE LEGALLY BINDING NATURE OF THIS AGREEMENT.

Genta Technology Terms and Conditions of Service

1. Definitions

Platform: The Genta Technology Platform includes the website, mobile applications, and other services provided by Genta Technology.

User: Any individual or entity that accesses or uses the Platform.

Content: All texts, images, videos, audio files, and other materials found on the Platform.

2. Acceptance of Terms and Conditions

By accessing or using the Platform in any manner, Users are deemed to have read, understood, and agreed to all these Terms and Conditions. If Users do not agree with these Terms and Conditions, they are prohibited from using the Platform.

3. Changes to Terms and Conditions

Genta Technology reserves the right to modify these Terms and Conditions periodically. Genta Technology will make reasonable efforts to notify Users of such changes through notices on the Platform, email, or by other means deemed reasonable. Users who continue to use the Platform after changes to these Terms and Conditions are deemed to have accepted those changes. Users are encouraged to review these Terms and Conditions periodically to be aware of any changes.

4. Platform Usage

The Platform is available to legitimate Users who meet the minimum age requirement per applicable laws. Users are prohibited from using the Platform to:

• Transmit or store illegal, harmful, threatening, abusive, harassing, defamatory, or privacy-violating content.

• Interfere with or disrupt the operation of the Platform or the servers or networks connected to the Platform.

• Infringe upon the copyrights, trademarks, trade secrets, patents, or other intellectual property rights of others.

• Send spam, unsolicited commercial emails, or other mass messages.

• Impersonate others or falsify information.

• Interfere, damage, or attempt to gain unauthorized access to Genta Technology’s or third parties' computer systems, networks, or accounts.

• Use the Platform for purposes that violate any applicable laws or regulations.

5. Content

The content on the Platform is owned by Genta Technology or other third parties and is protected by copyright and other intellectual property laws. Users are prohibited from using the Content for commercial purposes without prior written permission from Genta Technology or the rightful copyright owner. Users may only use the Content for personal, non-commercial purposes.

6. User Accounts

To access certain features of the Platform, Users may need to create an account. Users are responsible for maintaining the confidentiality of their account credentials (including username and password) and for all activities occurring under their account. Users must promptly notify Genta Technology of any suspected unauthorized use of their account or other security breaches.

7. Disclaimer and Limitation of Liability

The Platform and its Content are provided "as is" and "as available." Genta Technology makes no warranties or representations, express or implied, regarding the accuracy, completeness, fairness, or reliability of the Platform or its Content. Genta Technology shall not be liable for any loss or damage resulting from User’s use of the Platform, including but not limited to, damage due to errors, omissions, interruptions, viruses, file deletions, communication errors, theft, or destruction.

8. Service Termination

Genta Technology reserves the right to suspend or terminate User access to the Platform at any time, with or without cause, including but not limited to violations of these Terms and Conditions.

9. Governing Law

These Terms and Conditions shall be governed and interpreted in accordance with Indonesian law. Any disputes arising from or related to these Terms and Conditions shall be settled through arbitration in accordance with the rules of the Indonesian National Arbitration Board (BANI).

10. Entire Agreement

These Terms and Conditions constitute the entire agreement between Users and Genta Technology concerning the use of the Platform.

12. Language

These Terms and Conditions are available in Indonesian and English. In case of any conflict between the Indonesian and English versions, the Indonesian version shall prevail.

13. Severability

Should any provision of these Terms and Conditions be deemed invalid or unenforceable, that provision will be removed, and the remaining provisions will remain in effect.

14. Notices

Genta Technology may provide notices to Users via email, mail, or other means deemed reasonable by Genta Technology. Notices will be considered received by Users 24 hours after an email is sent, three days after a letter is mailed, or when a User receives a notice via other means.

15. Copyright

The Platform and its Content are protected by copyright and other intellectual property laws. Users may not copy, reproduce, distribute, or republish Content without written permission from Genta Technology.

16. Miscellaneous

Genta Technology may transfer its rights and obligations under these Terms and Conditions to another party. These Terms and Conditions may not be altered without Genta Technology’s written consent. These Terms and Conditions bind and benefit the parties and their lawful successors and assigns.

17. Security

Genta Technology is committed to protecting Users' data security. Genta Technology has implemented various security measures to protect Users' data from unauthorized access, disclosure, use, or alteration. However, Users understand and acknowledge that no security method is perfect and they are responsible for maintaining the security of their account credentials.

18. Privacy

Genta Technology is committed to protecting Users’ privacy. Genta Technology has implemented a Privacy Policy that explains how Genta Technology collects, uses, and discloses Users' data.

20. Questions and Complaints

If Users have questions or complaints about these Terms and Conditions, the Platform, or its Content, they can contact Genta Technology at [email protected]

21. Immediate Effectiveness

These Terms and Conditions are effective from the date Users access or use the Platform.

Additional Information

Genta Technology may add, remove, or modify the features and functionalities of the Platform at any time. Genta Technology may also add, remove, or change these Terms and Conditions at any time. Users are responsible for regularly reviewing these Terms and Conditions to stay informed of any changes.

Users may choose to stop using the Platform at any time. Users can delete their accounts by contacting Genta Technology at admin@genta.tech.

Genta Technology reserves the right to terminate or restrict User access to the Platform at any time, with or without cause.
